By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you may not use our Services.
1.1 Civil Host provides Server hosting services to customers who wish to host Servers for multiplayer online games and other uses. Our Services include server provisioning, server management, technical support, and related services. Not every service plan in entitled to every service. Server Management is an available addon for most service plans.
1.2 Civil Host reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.
2.1 Account Registration: In order to use our Services, you must create an account and provide accurate and complete registration information. You are solely responsible for maintaining the confidentiality of your account credentials.
2.2 Prohibited Use: You agree not to use our Services for any unlawful, fraudulent, or inappropriate activities. This includes, but is not limited to, transmitting any content that is illegal, harassing, defamatory, or infringing upon intellectual property rights.
2.3 Service Usage: You are responsible for the content and usage of your Service. Civil Host reserves the right to monitor Service usage and take appropriate action if any violation of this Agreement is detected.
3.1 Fees: The fees for our Services are outlined on our website or as communicated to you during the ordering process. You agree to pay all applicable fees associated with your use of the Services.
3.2 Payment Terms: Payment for the Services must be made in advance. Civil Host accepts various payment methods, as specified on our website. You agree to provide accurate and complete billing information.
3.3 Refunds: Under no circumstance will we provide refunds, unless required by law.
4.1 Ownership: Civil Host retains all rights, title, and interest in and to the Services, including any intellectual property rights associated with the Services. You acknowledge that you do not acquire any ownership rights by using our Services.
4.2 User Content: You retain ownership of any content you upload or transmit through our Services. By submitting content, you grant Civil Host a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute the content for the purpose of providing the Services.
5.1 Limitation of Liability: Civil Host provides the Services on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, error-free, or secure. You acknowledge that you use the Services at your own risk.
5.2 Indemnification: You agree to indemnify and hold Civil Host harmless from any claims, damages, liabilities, or expenses arising out of your use of the Services, including any violation of this Agreement.
6.1 Termination by You: You may terminate your account at any time by following the instructions provided on our website. Any fees paid in advance are non-refundable unless otherwise stated in our Refund Policy at the time of termination. If you request immediate cancellation, all data will be deleted. If you request end of billing period cancellation, all data will be deleted at the end of the billing period. Civil Host is not responsible for loss of data in the event a user breaches this contract. If a user does not pay all applicable fees each billing period, they are at risk of their data being automatically removed.
6.2 Termination by Civil Host: Civil Host may terminate this Agreement and your access to the Services without reason or if you violate any provisions of this Agreement engage in any fraudulent, illegal, or harmful activities. Civil Host is not responsible for loss of data in the event a user breaches this contract.
7.1 Modification: Civil Host reserves the right to modify this Agreement at any time. We will notify you of any material changes to this Agreement. Continued use of the Services after such modifications constitutes your acceptance of the updated Agreement.
7.2 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Maryland. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of Maryland.
7.3 Entire Agreement: This Agreement constitutes the entire agreement between you and Civil Host concerning the subject matter herein and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.
By using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
